on the day in question, the statement read. Officer xyz and I was doing our regular route; (rte.# etc.) travelling at a speed of 30 KMH when we encounter a school bus travelling about 40 or more KMH. passing us, turning without signaling, swinging and flashing recklessly blocking our vision etc. when we stop him he was acting cocky and “some other word” which Donald was not quite sure of. Note all these were written in another language other than English, so these info are from translation and interpretation. Furthermore, on this the court hearing day, the cop who issued the ticket did not show up but send another cop instead! Until this day Donald still cannot make sense of that. Why would he send someone else who is not a lawyer to represent him in court? Donald concluded that this was yet another miscalculation on the part of the cop, maybe because he see this bus driver just sitting there looking “dumbstruck” and not answering while he was talking to him that day, he concluded that he (the bus driver) is stupid so let’s clean him out of his entire pay check. Or, maybe he thought that; like so many of the others (people like him) he won’t show up in court and even if he does, he won’t even notice the difference anyway. EEEH. Wrong again. Furthermore, the interpreter which Donald had requested via the return mail which informed him of the particulars of the court hearing, was not provided, so with that along with him informing the court that this officer (present) was not the officer who issued the ticket and requesting that said officer be present in person, the case was adjourned. It was another 6-7 months before it was to be reconvene. When next the case came up for hearing, Donald arrived to find the (correct) police officer there in court, he was first on the stand when the case came up so he proceed to give his version of events as he said they transpired on that day. He began by stating that; on the day in question he was servicing his regular route/circuit when… He then went on to repeat almost word for word what was written in the “additional information files” which was provided, copies of which was given to Donald on his first appearance in the court some 6 months earlier. At the end he went a few steps back and stand back-against-the-wall resting his left hand atop a podium or something like that and waited.
Now it’s Donald’s turn to take the stand, the judge asked Donald whether he prefers to cross-examine the officer or to give his version of the events? After being told that he can only choose one of those options, Donald settle for giving his version. He said that; in the interest of time he wanted to confine his testimony to the portion of his route where he encounters the police car to which the court agrees. Donald then went into his testimony starting off with the very same words as the policeman did; on the day in question, I was servicing my regular route when… I stopped at one of my regular stops at the corner of Rue Laframboise and Deguire, this happens to be my biggest stop on the route meaning; this is where I pick up the most children, usually about 15-17, this morning was no different there were 17. Having my school bus flashing lights going, vehicular traffic comes to a stop in all three direction of the T-junction intersection. After all my students was aboard I closed the lights and waited for the intersection to be cleared of traffic then I continued on my route just then I noticed a police car in front of me travelling in the same direction as I and I was thinking to myself: where did he come from since I didn’t see him come through the intersection, anyway I continued behind the car travelling between 0 and 30 KMH,
Donald then proceeded to explain what that means. 0 means the speed (or lack thereof) at the stop signs which we passed through on that stretch of roadway. It was at this point that the police officer, who was still standing back-against-the-wall beside the podium, moved and walked a few steps across the sitting area and sat down. Note, in his testimony he said he was travelling at a speed of 30 KMH on his regular circuit. Well, there are some stop signs there on those streets travelled that morning.
Donald continued by rehearsing the sequence of events as they happened then. Both vehicles were travelling along boul. Deguire, the police car in the lead, the school bus following. On the approach to Quenneville, I signaled my intention to turn left, stop and turn still following the car which had itself, turned onto that street Quenneville. Quenneville turned left to become Marcotte, all this time we were being careful to keep our wheels within the beaten path of earlier passing traffic as this was in Feb. in the heights of winter and there were much snow on the roadways. On Marcotte, the police car proceeded to pull off of the roadway towards the right where there seems to be several available parking spots, the car bouncing and shaking as the wheels rides over the piles of snow in the middle and to the sides of the road. I assumed that the police was about to park and so I slowed to allow for time then continued on my way. I didn’t have to signal right or left because I didn’t need to turn, I just continued along following the beaten path of the snow on the road. Upon the approach to Rue Brochu, I signaled right, stop and then turn unto Brochu, I then noticed via the rearview mirror that that police car was now travelling behind me. On approaching Meloche, I signaled, stop then turn onto Meloche. Then via the rearview mirror again, I saw flashing lights which I interpreted as a signal for me to stop so I did. That’s when the officer came onto the bus and began to ask those questions… (Donald went over the questions and his responses and what he’d asked (and intend to ask) the policeman before he went away leaving him holding a fat ticket to pay).
